The alleged assignment took place through an agreement that was signed by the owners in April 2015, but the document did not include the signature of the previous Mayor of the PP, among other presumed irregularities.
This circumstance caused doubts in the current government team, since the document could not be valid because it does not have the signature.
The company that carried out the asphalting works presented the invoice and the current Mayor, José Moreno, requested reports to the different municipal services to decide if it had to be paid or not, since there was no assurance that the land was municipal property. .
Finally it was decided not to pay and the company sued the City for the non-payment.
The court of the Contentious-Administrative of Murcia gave the reason to the consistory for refusing to pay the invoice, since it could have incurred a crime of prevarication.
The judge considers in her writ that "it has not been possible to conclude with determination that the roads where the works were carried out were of public or private ownership".
The Councilor for Urbanism and socialist spokesman, Enrique Fuentes, said: "We could have committed a crime of prevarication, or even embezzlement of public funds, if the bill had been paid for works on lands that are not municipal."

He added that "we are not judicializing the policy, we sent the documentation to the Prosecutor's Office and we did not go to file a complaint to the courts, and after the provisional dismissal we have not gone to the Contentious Administrative Court".
